GENERAL TERMS AND CONDITIONS OF SUBRA PREMIUM CLUB

Effective as of August 1, 2023

These General Terms and Conditions govern the rules for obtaining and using a SUBRA PREMIUM CLUB card. The issuer and owner of the card is Alta Mar Ltd. The card may only be used in pharmacies operating under the “Subra Pharmacies” trademark. SUBRA PREMIUM CLUB is a customer loyalty program created and organized for Subra pharmacies.

The club card may be requested digitally through the Subra Pharmacies website at www.subra.bg. After creating an online account, SUBRA PREMIUM CLUB cardholders may use the card in physical Subra pharmacies and for online purchases.

Points from completed purchases are accumulated only upon prior presentation of the physical card or the linear barcode generated after requesting a card through www.subra.bg.

Cashback generated from accumulated points may only be used in physical pharmacy locations.

Members may obtain any information regarding the SUBRA PREMIUM CLUB card by email at marketing@subra.bg or at any Subra pharmacy.

The card owner reserves the right, at its sole discretion, to amend these General Terms and Conditions, terminate the SUBRA PREMIUM CLUB program, and block issued SUBRA PREMIUM CLUB cards if they do not comply with the stated conditions. All decisions related to SUBRA PREMIUM CLUB shall be publicly announced on www.subra.bg and shall enter into force on the date of publication unless otherwise specified.

The SUBRA PREMIUM CLUB card remains valid until the publication of a notice terminating SUBRA PREMIUM CLUB or until receipt of a termination request from the cardholder. The holder of a SUBRA PREMIUM CLUB card may leave the SUBRA PREMIUM CLUB program at any time by submitting a written request via email to office@subra.bg or marketing@subra.bg, thereby discontinuing the use of the card and forfeiting all associated benefits.

Upon termination of membership, the personal data controller undertakes to delete all personal data of the cardholder who has withdrawn from the SUBRA PREMIUM CLUB program.

Alta Mar Ltd. shall not be liable for any damages suffered by cardholders due to technical issues or force majeure events that prevent the operation of computer systems.

SUBRA PREMIUM CLUB

Any natural person meeting the requirements of these General Terms and Conditions is entitled to benefit from various discounts and promotions when purchasing products from Subra pharmacies within the territory of Bulgaria, valid at the time of purchase, by using a SUBRA PREMIUM CLUB card. Cardholders may also participate in additional promotions and marketing campaigns announced by Subra pharmacies, provided they meet the applicable participation requirements.

A SUBRA PREMIUM CLUB card may be issued to any adult individual with legal capacity and a permanent address in the Republic of Bulgaria.

For purchases of products eligible under the SUBRA PREMIUM CLUB program, points are accumulated only on the card of the individual customer. An invoice may not be issued to a legal entity for purchases made using a Premium Card. If the customer requests an invoice issued to a legal entity, the customer card shall not be applied and no points shall be accumulated for the purchased products.

Subra Pharmacies reserves the right to deduct accumulated points from a Premium Customer Card where abuse or violations of the usage rules have been established.

By registering through www.subra.bg, completing all mandatory fields in the online registration form, and expressly confirming that all information provided is true and accurate, that the individual agrees to these General Terms and Conditions, and consents to the processing of their personal data. After completing the registration form, an email containing a link to the Subra Pharmacies website is sent to the applicant. The member must open the link to confirm their email address and complete the online registration process.

The SUBRA PREMIUM CLUB card may also provide various short-term benefits to its users, individually tailored to the personal data provided in the membership application and/or to the purchase history of each cardholder.

A SUBRA PREMIUM CLUB card may only be registered to one individual (first name, last name, city/town, telephone number, mobile operator, and email address), and a second SUBRA PREMIUM CLUB card cannot be issued to the same person.

The SUBRA PREMIUM CLUB card operates on the principle of accumulating the value of all purchases.

The following are excluded from point accumulation under the SUBRA PREMIUM CLUB program:

Medicinal products dispensed by prescription pursuant to Ordinance No. 28 under the Medicinal Products in Human Medicine Act (LPHM), Article 2 and Article 4;
Products sold at promotional or special prices.
Points Accumulation System

For every BGN 1 (EUR 0.51) spent on eligible products, the holder of a SUBRA PREMIUM CLUB card receives 2 points. Under no circumstances may the card, the points accumulated, or the rights arising from them be redeemed for cash.
Accumulated points and unused cashback are reset at the end of each calendar year.
If a customer has not used their Subra Premium Card for 24 months, the card shall be blocked and declared invalid.
The card must be presented at the beginning of the purchase process. No points shall be accumulated if the receipt has already been finalized and the card was not presented before the purchase.
Points from a completed sale are credited immediately after the purchase; however, if they generate cashback, the cashback becomes available for use after 00:00 hours.
How Points and Cashback Are Generated

There are three levels for point accumulation and cashback generation. Upon reaching a respective level, cashback is generated only for that level.

• When a SUBRA PREMIUM CLUB cardholder accumulates 1,400 points, they receive cashback totaling BGN 50 (EUR 25.56).

• When a SUBRA PREMIUM CLUB cardholder accumulates 2,600 points, they receive cashback totaling BGN 100 (EUR 51.13).

• When a SUBRA PREMIUM CLUB cardholder accumulates 4,000 points, they receive cashback totaling BGN 150 (EUR 76.69).

How Cashback Is Used

• Generated cashback of BGN 50, BGN 100, or BGN 150 may be used for a single purchase with a value equal to or greater than the cashback amount.

• If the value of the purchase exceeds the cashback amount, the customer pays the difference.

• After using cashback of BGN 50, BGN 100, or BGN 150, the points that generated the cashback are reset to zero.

Example: If you have accumulated 2,600 points, you are entitled to cashback of BGN 100 (EUR 51.13). Once you use the cashback, the 2,600 points will be reset.

The SUBRA PREMIUM CLUB card is not a bank card and is not a payment instrument.

In cases of a lost, stolen, or damaged card, the card shall be blocked from the date on which the issuer and owner of the card are notified.

By participating in SUBRA PREMIUM CLUB and accepting these General Terms and Conditions, each member:

(a) declares that, when completing the application form, they provide their own personal data;

(b) declares that they are informed of the purposes and conditions for processing their personal data and voluntarily provide such data;

(c) expressly, voluntarily, and knowingly consents, in accordance with Article 4 of the Personal Data Protection Act, to the processing of their personal data by entities operating under the Subra Pharmacies trademark and by the persons specified in these General Terms and Conditions, for the purposes and under the conditions stated herein, including consent to processing by automated means;

(d) expressly, voluntarily, and knowingly consents to the use of their personal data for direct marketing purposes in accordance with these General Terms and Conditions;

(e) declares that they have been informed of their right to object at any time to the processing of their personal data for direct marketing purposes.
